  • Serious or repeated breaches will result in blacklisting and permanent removal from the platform.

Dispute Resolution

  • Aim to resolve any disagreements in a respectful and professional way.

  • Perfect Pair Au Pairs will assist with mediation if needed.

Legal Terms & Platform Use

Messages and Advertising
Data Messages between You and Perfect Pair Au Pairs

  • Data messages, including email messages, you send to us will be considered as received only when we acknowledge or respond to these messages.

  • Data messages we send to you will be regarded as received when the data message enters your email server inbox and is capable of being retrieved and processed by you.

  • We reserve the right not to respond to any message that contains obscene, threatening, defamatory or otherwise illegal, unlawful, or inappropriate content.

  • Messages sent over the internet are not guaranteed secure. We are not responsible for any message intercepted, lost, or corrupted.

Hyperlinks, Deep Links, Framing

  • The Platform may include links to other websites (“other sites”). We do not own or endorse these other sites.

  • Your use of other sites is at your own risk and subject to their terms.

  • We are not responsible for content on any other site.

Intellectual Property
Platform IP

  • All platform content and underlying software is owned by Perfect Pair Au Pairs or its partners and is protected under law.

User Submitted IP

  • You retain ownership of your own IP, but grant us a non-exclusive, non-transferable license to use it for our services.

No Modification of IP

  • No content may be copied, modified, distributed, or used without our written consent.

Updates

  • We may update or change any platform content at any time, but completed transactions won’t be affected.

Third-Party IP

  • Third-party IP remains subject to their terms, which you agree to follow.

User License

  • You receive a personal, non-transferable license to view platform content; no ownership rights are granted.

Indemnities and Disclaimers
Disclaimers

  • The Platform and Services are provided “as is”. We make no guarantees regarding accuracy, suitability, or availability.

  • We are not liable for losses arising from use of the Platform, Services, or candidate-family engagements.

  • We take security precautions but are not responsible for technical failures or breaches.

Indemnities

  • You agree to indemnify Perfect Pair Au Pairs for any claims, legal fees, or damages resulting from your use of the Platform/Services or breach of Terms.

  • This clause survives termination of agreement.

Dispute Resolution
Negotiation

  • Parties must first attempt to resolve disputes through negotiation.

Mediation

  • If unresolved, an independent mediator will be engaged.

Arbitration

  • If mediation fails, binding arbitration will follow under AFSA rules.

Jurisdiction

  • South African courts have jurisdiction. Parties may also use applicable tribunals or ombuds.

No Publication

  • Parties agree not to publicise disputes on social media or public platforms.

Disputes between Users
Private Dispute

  • Disputes between you and a Family are private and outside our responsibility.

Beneficial Resolution

  • You agree to resolve such disputes amicably.

Notification

  • You may inform us of the dispute, but we are not obliged to intervene.

Termination of Use

  • We may terminate your use of the Platform if you breach these Terms.

  • You may terminate with 2 weeks’ notice.

  • On termination, we will remove you from the Platform and delete your profile.

Notices and Service Address

  • Notices must be sent to:

  • Changes of address are effective 14 days after written notice.

  • Notices received are valid even if not sent according to this clause, as long as received and understood.

Complaints and Support Enquiries

  • Use the Platform’s built-in prompts for any complaints or support queries.

Relationship Between Parties

  • These Terms do not create a partnership, employment, or agency relationship.

Force Majeure

  • Neither party is liable for failure to perform due to events beyond their control (e.g. natural disasters, political unrest, pandemics).

Change Without Notice

  • These Terms may change without notice. Continued use signifies acceptance.

Entire Agreement

  • This document is the full agreement. No other variations apply unless published.

No Indulgence

  • Any leniency by us does not waive our rights.

Importation of Words

  • Singular includes plural; gender is inclusive; persons include juristic entities.
